TERMS OF SERVICE AGREEMENT
This User Agreement (hereinafter referred to as the Agreement) is a public offer and governs the relationship between Cosmoport Entertainment Ltd. (hereinafter referred to as the Seller) and any natural person having the right and legal capacity (hereinafter referred to as the Buyer) arising from the making of the electronic order and purchasing goods and services through the cosmoport.eu website.
The Seller has the right to refuse the Buyer to place the order in case the Buyer does not agree and comply with the Agreement terms. The fact of ticket purchase means that Buyer unconditionally accepts, agrees to abide to the terms of this Agreement. By purchasing the Ticket, the Buyer accepts the visiting rules of the entertainment centre “Cosmoport”.
The definitions used in this Agreement have the following meaning:
– Site – Information and refference resource located in the Internet at cosmoport.eu
– Centre — Educational and Entertainment centre “Cosmoport”
– Online Order (Order) — is a digital record in the database of the Cosmoport Educational and Entertainment Center confirming the fact of booking and paying for the visit to the center, as well as the Goods selected by the Buyer.
– Ticket — a document certifying the Visitor’s right to visit the Entertainment Centre.
– Goods — products and / or services sold by the Seller, information about which is indicated on the Site. The cost of the Goods is not included in the price of the Ticket and is paid additionally, while the Seller has the right to display in the order the total cost of the purchased Tickets and Goods without breakdown.
– Visitor — individual who purchased (or intends to purchase) the Ticket through Online Order in order to visit Educational and Entertainment Centre “Cosmoport”
– Event– an event organised in the Centre.
2.Subject of the agreement
2.1.The Seller provides the Buyer with the opportunity to make an Electronic order for tickets and Goods on the terms of this Agreement.
2.2.Unconditional acceptance (acceptance) of the terms of this Agreement is the fact of payment by the Buyer of the Order. The Seller acts on his own behalf. All obligations under this Agreement arise directly from the Seller and the Buyer.
2.3.Discounts valid for Preferential categories of citizens, in the case of an Electronic order through the site, do not apply, as appropriate confirmation is required, except as otherwise provided by this Agreement.
3.1.«Regular Ticket» – ticket for a single visit to the Event at the Center, per Visitor.
3.2.«Group Ticket» – a ticket granting the right to attend an event at the Center by a group of Visitors.
3.3.«Gift Certificate» – a ticket (issued on a special form) giving the right to visit the Center once within 90 days (inclusive) from the date of its purchase. Ticket validity starts from the date of purchase.
4.Conditions and procedure for making an electronic order:
4.1.To make an Electronic Order on the website, the Buyer performs the following actions:
– Selects the type of Program in the Center;
– Selects the Time and Day of this Program;
– Selects the number of Visitors;
– Proceeds to booking by clicking the “Book” button;
– Fill in full name, phone number, email address;
– Confirms the booking, thereby agreeing to the terms of this Offer;
– The Seller confirms the booking by calling or sending an information letter to the Buyer’s e-mail address.
4.2.When placing an Order, the Buyer is obliged to provide the necessary correct, accurate and complete information about himself. The buyer is responsible for minor children in whose interests he places the Order.
4.3.The Buyer is obliged to familiarize himself with the age restrictions for visiting the Center, as well as take into account the compliance with the age restrictions of underage Visitors on the date on which the Order is placed.
4.4.The Buyer can make an Electronic Order only for the number of Tickets and Products that are available for sale on the site at the time of the Order for the selected program.
5.Visit to the Edutainment center “Cosmoport»
5.1.The buyer can enter the playing area only if he has a ticket.
5.2.Only a legal and capable natural person is entitled to receive a paid Order.
5.3.Visiting the Center with one ticket is possible only once and only for one Visitor of the category specified in the ticket.
5.4.The Buyer is solely responsible for the safety and protection against distribution of the individual Ticket number. In the case of distribution of an individual number, access to the Center will be open to the person who first presents an individual ticket number.
5.5.The Buyer is fully responsible for minor children and agrees that a minor child, as well as the Buyer himself, may be denied entry to the Center on a Ticket in case of violation of the established age restrictions, as well as violations of the rules of the Center. The Seller reserves the right to require a document confirming the age of the Visitor. In the absence of such a document, the Seller has the right to refuse such a person to visit the Center and return the money paid for the tickets.
5.6.In case of visiting the Center with a Gift Certificate, you must book the date and time of the visit at least 2 (two) days in advance by phone +357 25000140 or by mail email@example.com, otherwise the Seller does not guarantee the possibility of visiting on the selected day.
6.Conditions for the return of Tickets, Subscriptions and Gift Certificates
6.1.The Buyer has the right to return the Tickets:
6.1.1.The return of the Ticket is possible no later than the day preceding the date of visiting the Center indicated in the ticket.
6.2.With regard to the Gift Certificate, the return is possible no later than the day preceding the last day of the validity period of the Gift Certificate indicated in the certificate.
6.3.The return is processed directly at the address of the location of the Educational and entertainment center “Cosmoport” from 10:00 to 20:00.
To process a return, you must be present in person. The buyer must have a Passport and a Ticket/Certificate.
6.4.In case of return of the Ticket/Certificate, the Seller has the right to recover from the Buyer its actual expenses caused by the Buyer’s refusal. In case of cancellation of the order later than 24 hours before the date of the visit to the Center specified in the Ticket/Certificate, the amount of the Seller’s actual expenses in relation to the tickets is 100% of their cost.
7.Rescheduling the time and/or date of the visit
7.1.If the Buyer has paid for the Ticket and wants to reschedule the time and / or date of visiting the Center, then he must send from the email address that he indicated when placing the Electronic Order to the email address: firstname.lastname@example.org a letter indicating the numbers Tickets and a request to reschedule the time of the session or the date of the visit to another time, indicating the planned date or time of the visit.
7.2.A letter on the postponement of the date and / or time of the Visit must be sent by the Buyer no later than 24 hours before the start of the session on the date of the visit indicated in the Ticket.
7.3.The Seller considers the Buyer’s electronic request within 1 day and gives an answer about the possibility / impossibility to transfer the date of the visit. The transfer is carried out only on a date and time that is identical in cost to the date and time specified in the Ticket.
7.4.The seller has the right to refuse to change the date of the visit without specifying the reasons for such refusal. In this case, the Buyer shall return the Tickets in the manner prescribed by the provisions of section 6 of this Agreement.
8.1.The Buyer agrees that:
8.1.1.The Seller has the right to suspend or terminate the sale of Tickets and / or Goods through the Site at any time without giving reasons and without prior notice to the Buyer. Termination or suspension of the sale may be made, including, but not limited to, in connection with the violation by the Buyer of this Agreement and / or the occurrence of technical circumstances, such as malfunctions of the Site, malfunctions of payment systems, failures in communication systems, etc.;
8.1.2.The site may contain links to other Internet resources, while the Seller is not responsible for the availability of these resources, for their content, as well as for any consequences associated with the use of materials from these resources;
8.1.3.The Seller has the right to engage third parties to fulfill its obligations under this Agreement;
8.1.4. the data specified by the Buyer on the Site may be provided by the Seller at the request of the authorities and persons authorized to request and receive such information in accordance with applicable law;
8.1.5.The Service is provided “as is” (“as is”) and in the form in which it is available at the time of provision, while no warranties, express or implied, are provided (including, but not limited to, warranties that the Service will be used for a particular purpose);
8.1.6.This Agreement may be changed by the Seller unilaterally by posting a new text of the Agreement on the Seller’s website cosmoport.eu. The current version of the Agreement is considered to be the one posted on the Seller’s website at the time of its application (at the time of payment for the Electronic Order by the Buyer).
8.1.7.The Seller does not guarantee the possibility of recovering an e-mail with the number and data of the Tickets received by the Buyer after paying for the Order, in case of loss by the Buyer.
8.1.8.If it is impossible to visit the Center due to the fault of the Seller (including due to force majeure circumstances), he refunds the cost of the Electronic Order to the Buyer under the terms of the provisions of section 5 of the Agreement.
8.2.The Seller is not responsible:
8.2.1.for the actions of banks, electronic payment systems that ensure the transfer of funds under this Agreement;
8.2.2.for delay, failure, impossibility and untimely delivery, deletion or non-storage of any data, as well as non-compliance of the Service with the needs or expectations of the Buyer;
8.2.3.for any damage or loss caused to the Buyer, including, but not limited to, as a result of any changes (which the Seller makes on the Site) to the procedure for the provision of the Service, as well as as a result of the termination or suspension of the provision of the Service, the removal, failure or failure to save any – any contained or transmitted data, inaccuracies and / or unreliability of the data specified by the Buyer;
8.2.4.in the event of force majeure circumstances, which include, but are not limited to, natural disasters, hostilities, a national crisis, strikes in an industry or region, actions, decisions of state bodies that objectively impede the fulfillment of obligations under this Agreement, as well as failures that have arisen in telecommunications and/or energy networks, the action of malicious programs, unfair acts of third parties, expressed in actions aimed at unauthorized access and/or disabling of the software and/or hardware complex of the Seller;
8.2.5.in case of violation by the Buyer of the Rules for visiting the Center.
8.3.The Seller’s liability to the Buyer is limited to the value of the purchased Tickets and/or Goods.
8.4.The Seller independently determines the cost of visiting the Center and the Goods. Information about the current cost of the Visit and Goods, as well as changes in the cost of the Visit and / or Goods is provided to the Buyers at the entrance area of the Center and is published by the Seller on the official website of the Center. All disputes or disagreements arising between the Parties under this Agreement or in connection with it shall be resolved through negotiations. This Agreement provides for a claim procedure for resolving disputes.
8.5.All claims are sent by registered mail with acknowledgment of receipt. The term for consideration of a claim is ten calendar days from the date of its receipt by the Party.
8.6.In case of failure to reach an agreement by resolving the dispute in the complaint procedure, all disputes arising in connection with the execution by the Parties of this Agreement shall be resolved in court in accordance with the current legislation of the Republic of Cyprus.
8.7. The Buyer agrees to the Seller to process his personal data, including full name, date, month, year of birth, phone number, email address and other information provided, using automation tools and without them, including collection, recording, automation, accumulation, storage, clarification (update, change) extraction, use, transfer, depersonalization, blocking, deletion, destruction of personal data. Consent is given for the purpose of processing and fulfilling an electronic order for the period necessary to achieve the goals of processing and can be withdrawn in writing by sending an official request to the address of the Seller with a mark of receipt.
8.8.The Buyer agrees to the Seller to process the personal data of a minor Visitor (being his legal representative and purchasing a ticket in his interests), including full name, date, month, year of birth, phone number, email address, gender.
